“Transnationalising Constitutional Review – The Austrian Example”

Abstract
In a remarkable decision in 2012, the Austrian Constitutional Court decided to apply the EU Charter on Fundamental Rights in equivalence to Austrian fundamental rights. This judgment leads to a stronger integration of the Court into the European constitutional network and significantly changes its function. The talk will serve to explain the legal and cultural background of the decision and provide an outlook regarding future constitutional consequences. Can Austria serve as best practice or is the European trend moving in the opposite direction?
